Terms of Use

Welcome to marathonrealestateut.com (the "Site"), operated by Marathon Real Estate LLC ("Marathon," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the Site. By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About Marathon Real Estate

Marathon Real Estate LLC is a Utah-registered real estate investment company that buys properties for cash. Traditional real estate listing services are provided by Dylan Spence in his capacity as a licensed Utah Sales Agent (UT RE License #12210666-SA) affiliated with Red Rock Real Estate (Utah Brokerage License #8169072 CN00). Marathon Real Estate LLC is not a brokerage.

Depending on the transaction, Marathon may act as a principal buyer (purchasing your property for our own account, potentially to resell at a profit) or as a real estate agent representing you in a listing. This role will always be disclosed in writing before any contract is executed.

2. Eligibility

You must be at least 18 years old and legally able to enter into binding contracts to use the Site or submit a lead form. By using the Site, you represent that you meet these requirements.

3. No Real Estate Offer or Contract via the Site

Information on the Site, including any cash offer estimates, property valuations, listing recommendations, or other content, is for informational purposes only and does not constitute a binding offer to purchase or sell real estate. No real estate contract is created through this Site. Any binding purchase, sale, or listing agreement requires a separate written contract signed by both parties.

4. Cash Offers

If we provide you with a cash offer for your property, that offer is:

  • Non-binding until reduced to a written purchase agreement signed by both parties
  • Subject to inspection, title review, and verification of property condition and ownership
  • Based on the property's as-is condition, location, current market data, and our internal underwriting
  • Reflective of investor pricing, which may differ from retail market value

You are under no obligation to accept any offer we make. Initial consultations and cash offers are free of charge.

5. Wholesaling Disclosure

In some transactions, Marathon may purchase your property with the intent to assign the contract to another buyer or to resell the property to a third party at a profit. This is commonly known as "wholesaling" or "double-closing." We will disclose this intent in writing before you enter into any binding agreement. You acknowledge and understand that:

  • The price we offer is based on our investment criteria, not necessarily the highest possible retail price your property could achieve through a traditional listing
  • You may choose to pursue a traditional listing instead, and we will not pressure you to accept a cash offer
  • You have the right to consult independent counsel, a real estate agent, or other advisors before signing any agreement

6. Listing Services

When Marathon provides traditional real estate listing services, those services are provided by Dylan Spence acting in his capacity as a licensed Utah Sales Agent affiliated with Red Rock Real Estate (Brokerage License #8169072 CN00). A separate listing agreement, including commission terms and disclosures required by Utah law, will be executed before any listing services begin.

7. Use of the Site

You agree to use the Site only for lawful purposes. You agree not to:

  • Submit false, inaccurate, or fraudulent information
  • Use the Site to harass, abuse, or harm another person
  • Attempt to gain unauthorized access to the Site or any related systems
  • Use automated tools to scrape, harvest, or extract data from the Site
  • Interfere with or disrupt the Site's operation

8. Property & Market Information

Any property statistics, neighborhood data, market trends, or comparable sales information shown or referenced on the Site is provided for general information only. We do not guarantee the accuracy, completeness, or timeliness of this information. Always verify independently before relying on it.

9. Lead Submissions

By submitting a lead form, you confirm that:

  • You are either the owner of the property or are authorized to inquire about it on behalf of the owner
  • The information you provide is accurate to the best of your knowledge
  • You consent to our use of your information as described in our Privacy Policy
  • You agree to receive marketing communications (calls, texts, emails) from Marathon as described in our Privacy Policy and TCPA disclosure

10. Intellectual Property

All content on the Site — including text, graphics, logos, photos, layouts, and code — is owned by Marathon Real Estate LLC or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

11. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or secure. Nothing on the Site constitutes legal, tax, financial, or investment advice. Consult appropriate professionals before making real estate, financial, or legal decisions.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MARATHON REAL ESTATE LLC AND ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SITE OR ANY INFORMATION OBTAINED THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

13. Indemnification

You agree to indemnify and hold harmless Marathon Real Estate LLC and its owners, employees, agents, and affiliates from any claim, loss, damage, liability, or expense (including reasonable attorney fees) arising from your breach of these Terms or your misuse of the Site.

14. Third-Party Services

The Site may use third-party services for hosting, forms, analytics, advertising, and email. Your use of those services may be subject to their own terms and privacy policies, which we recommend you review.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Washington County, Utah, and you consent to the personal jurisdiction of those courts.

16. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after revisions constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
